Indian Jute Mills Association Wins Case Against Union of India; Jute Commissioner Directed to Adhere to Approved Pricing Methodology


In a significant judgment, the Calcutta High Court has ruled in favor of the Indian Jute Mills Association, directing the Jute Commissioner to adhere to the pricing formula approved by the Cabinet Committee on Economic Affairs (CCEA) for the fixation of jute bag prices. The court's decision, delivered by Justice Smita Das De, mandates compliance with the CCEA-approved pricing methodology communicated by the Ministry of Textiles, deeming any deviation from it as arbitrary and violative of Article 14 of the Indian Constitution.


The case, Indian Jute Mills Association & Another v. Union of India & Another, revolved around the pricing of jute bags for October and November 2025, which the petitioners contended was not set according to the established CCEA formula. The petitioners argued that the Jute Commissioner failed to issue the necessary pricing notifications, resulting in a regulatory vacuum that affected procurement obligations under the Jute Packaging Materials Act.


The court underscored that the CCEA's pricing formula is a binding policy directive, and the Jute Commissioner, as a subordinate authority, is legally obligated to implement it without deviation. Justice Das De emphasized the rule of law and the doctrine of legitimate expectation, stating that any departure from the prescribed standards without rational justification would be susceptible to judicial review.


The judgment highlighted that the petitioners, representing the jute industry, have a legitimate expectation that the notified formula would be uniformly implemented, as they regulate procurement and financial planning based on this pricing mechanism. The court also directed the payment of the differential amount between the CCEA formula-determined prices and the actual prices paid for supplies in October and November 2025, with an interest rate of 9% per annum in case of delay.


This ruling reinforces the importance of adherence to approved government policies and provides clarity for the jute industry regarding pricing expectations. The court's decision is seen as a significant step toward ensuring fair pricing practices and maintaining the integrity of government-mandated supply chains.
