Court Considers Passage of Time and Absence of Criminal Antecedents in Sentencing Decision


In a significant judgment, the Calcutta High Court upheld the conviction of Mahadeb Das, also known as Manadev Das, for assault under Section 323 of the Indian Penal Code (IPC), while modifying his sentence from imprisonment to probation. The judgment, delivered by Justice Chaitali Chatterjee Das on February 9, 2026, considered the 20-year lapse since the incident and the absence of any subsequent criminal activity by the petitioner.


The case stemmed from a complaint filed on February 22, 2005, by the victim, alleging that Mahadeb Das assaulted him in front of the A.D.S.R. Office in Tamluk. The trial court had initially sentenced Das to six months of simple imprisonment, which was affirmed by the appellate court. However, considering the extended passage of time and the petitioner's clean record since the incident, the High Court decided to grant him the benefit of probation under Section 360 of the Criminal Procedure Code (Cr.P.C.).


Despite the defense's arguments challenging the credibility of medical reports and witness testimonies, the court found the evidence sufficient to uphold the conviction. The court noted that minor discrepancies in witness statements did not undermine the overall consistency of the prosecution's case, supported by medical evidence and testimonies from witnesses, including the victim's friend.


The court directed Mahadeb Das to pay a compensation of Rs. 30,000 to the victim and to furnish bonds with an undertaking to maintain peace and good behavior for six months. The decision emphasizes the court's balanced approach, weighing the seriousness of the offense against the mitigating factors of time and subsequent conduct.
