The transfer, executed without prior approval from the Election Commission of India, was challenged as being contrary to the statutory provisions governing electoral administration.
The court examined the constitutional framework under Article 324, which confers superintendence, direction, and control of elections to the Election Commission, and reiterated that officers engaged in electoral duties are deemed to be on deputation to the Commission. The appellant, Dipti Mandavi, contended that the transfer had already been implemented, and administrative arrangements were finalized.
