College disrupted by criminal conduct of its management - Warrants judicial intervention

Bombay High Court Intervenes to Restore Order in College Amidst Management Disputes. Extraordinary Judicial Measures Taken to Address Suspension Orders and Ensure Academic Continuity
The Bombay High Court, Aurangabad Bench, has taken significant judicial steps to address the alarming situation at Kohinoor Arts, Commerce & Science College in Khultabad, Chhatrapati Sambhajinagar. The college has been embroiled in disputes due to alleged criminal activities by its management, leading to paralysis of academic activities. On September 23, 2025, Justices Manish Pitale and Y.G. Khobragade issued interim directions to ensure the safety and functioning of the institution, highlighting the need for judicial intervention in extraordinary circumstances.
The court was approached by several employees challenging their suspension orders and seeking the appointment of an Administrator and transfer of management due to alleged malfeasance by the college's management. The court granted interim relief by staying the suspension orders, noting the prima facie mala fide nature of these orders intended to subjugate staff. The judgment underscored the necessity of judicial intervention when alternative remedies are inadequate to address extreme situations affecting educational institutions.
The court directed the Joint Director of Higher Education to deputize an officer to ensure the smooth functioning of the college. Additionally, the local police were instructed to establish a presence within the college premises to prevent any untoward incidents. The court also restrained the President and Secretary of the college's management from entering the premises, given their criminal antecedents and the multiple FIRs registered against them.
The judgment is a crucial step in safeguarding the academic future of students and ensuring a secure environment for the staff. The court's directions aim to restore normalcy and protect the college's educational activities from being compromised.
Bottom Line:
Extreme and extraordinary circumstances warranting judicial intervention to ensure the safety and functioning of a college disrupted by alleged criminal conduct of its management.
