Delhi High Court Affirms Child Care Leave for Private School Teachers

Teachers in private unaided schools in Delhi entitled to CCL benefits akin to government school employees, rules court

In a significant ruling, the Delhi High Court has extended the entitlement of Child Care Leave (CCL) to teachers working in unaided, recognized private schools in Delhi, aligning their benefits with those granted to government school employees. The judgment was passed in the case of Sangeeta Negi v. Bharti Public School, where the court overruled a prior decision by a single judge and directed the respondent school to reconsider the appellant's request for CCL.

The court's decision is rooted in the interpretation of the Delhi School Education Act, 1973, specifically Section 10, and the Delhi School Education Rules, 1973, Rule 111. These provisions mandate that the employment benefits for staff in recognized private schools should not be inferior to those in government schools. The ruling emphasized that CCL is a societal benefit aimed at supporting family life and children's welfare, which aligns with Article 21 of the Indian Constitution, underscoring the right to life and personal liberty.

The case arose when Sangeeta Negi, a teacher at Bharti Public School, was denied CCL by her employer. She had sought leave to support her son facing academic pressures. Her plea was initially dismissed based on earlier judgments, but the Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia found merit in her appeal.

The court referenced the Central Civil Services (Leave) Rules, 1972, which grant CCL to female government servants, and ruled that these provisions apply to private school teachers under Rule 111 of the Delhi School Education Rules. The judgment also highlighted the broader societal goals of CCL, which include ensuring a parent's right to family life and securing the health and welfare of children.

This decision is expected to have a significant impact on the teaching community in Delhi, ensuring that private school teachers receive equitable treatment regarding leave benefits. The court has directed Bharti Public School to expedite the reconsideration of Sangeeta Negi's application for CCL.

Bottom line:-

Teachers in unaided, recognized private schools in Delhi are entitled to Child Care Leave (CCL) at par with employees of government schools under Rule 111 of the Delhi School Education Rules, 1973, read with Section 10 of the Delhi School Education Act, 1973.
