Delhi High Court Denies Anticipatory Bail in Major Cyber Fraud Case

Court highlights necessity for custodial interrogation to unravel conspiracy behind alleged "digital arrest" scam.

In a significant ruling, the Delhi High Court has denied anticipatory bail to Oma Kant Gupta, implicated in a high-profile cyber fraud case involving the alleged "digital arrest" modus operandi. The decision was delivered by Justice Dr. Swarana Kanta Sharma on March 12, 2026, underscoring the need for custodial interrogation to uncover the broader conspiracy involved in the case.

The case stems from a complaint lodged by Smt. Indu Mahajan of Greater Kailash, New Delhi, who alleged that she was deceived into transferring large sums of money under the guise of a judicial order and surveillance. The fraudsters employed a sophisticated scheme, using forged judicial documents to convince the complainant of her "digital arrest" due to an alleged involvement in money laundering. The complainant was instructed to transfer Rs. 30,00,000 and Rs. 80,10,010 into accounts linked to the accused.

During the investigation, it was revealed that significant transactions had been funneled through accounts associated with Oma Kant Gupta, leading to suspicions of his involvement. Despite his claims of being a victim of hacking, evidence such as mobile phone activity and financial transactions painted a different picture. The court took note of the suspect's failure to respond to investigation notices and the suspicious movement of funds through his accounts.

Justice Sharma, in her judgment, emphasized the increasing instances of such cyber frauds and the critical need to protect public trust in judicial systems. The court cited the Supreme Court’s observations on the gravity of such offenses, noting the necessity for coordinated action nationwide.

The ruling also highlighted the Supreme Court's suo motu writ petition regarding "digital arrests" and the use of forged documents, underscoring the severity of the allegations and the potential threat to public trust in judicial institutions. The court was firm in its stance that granting anticipatory bail could hinder the investigation, particularly when custodial interrogation is essential to unravel the full extent of the conspiracy.

The denial of bail sends a strong message about the judicial system's intolerance towards cybercrimes, particularly those involving the manipulation of judicial processes. The decision underscores the judiciary's commitment to safeguarding the integrity of its processes and protecting citizens from sophisticated fraud schemes.

Bottom Line:

Anticipatory bail denied in a case involving cyber fraud and the alleged "digital arrest" modus operandi, where custodial interrogation was deemed necessary to uncover the conspiracy.
