The investigation revealed that the contractors had failed to implement necessary safety measures such as barricades and warning signs, as mandated by the contract and traffic permissions.


The State's counsel argued that the contractors, despite being informed of the incident, did not notify the police or arrange for emergency medical aid. Instead, they allegedly attempted to conceal the site conditions post-incident. The court found that the contractual obligations for safety and compliance were non-delegable and rested squarely with the primary contractor, KKSIL, and its directors.


The court scrutinized the contractual terms and emphasized that the contractors bore absolute responsibility for safety during the project's execution. It dismissed the defense's argument that the applicants were suspended directors and thus not liable, pointing out their active involvement and communication regarding the project even after the purported suspension.
