Accused's Repeated Marriage Assurances Despite Non-Matching Kundalis Lead to Bail Rejection Amidst Ongoing Investigation


In a significant ruling, the Delhi High Court has denied bail to Jayant Vats, accused of sexual exploitation under the false promise of marriage. The court observed that despite knowing the importance of matching kundalis (horoscopes) in his family, the accused allegedly continued to assure the complainant of marriage, thus forming a prima facie case under Section 69 of the Bharatiya Nyaya Sanhita, 2023.


The prosecutrix, Ms. S, filed a complaint on January 3, 2026, alleging that Vats had been in a relationship with her since 2018 and had established physical relations based on assurances of marriage. However, Vats later refused marriage citing non-matching kundalis, despite his earlier assurances that this was not an issue.


The court, presided over by Dr. Swarana Kanta Sharma, J., noted that the applicant's conduct appeared inconsistent with his representations over the years. It was highlighted that the prosecutrix withdrew an earlier complaint in November 2025 based on renewed assurances of marriage, which were not honored.


The defense argued that the relationship was consensual, pointing out the couple's eight-year acquaintance and the failure of marriage due to astrological differences. However, the prosecution presented WhatsApp conversations where the accused assured the complainant that their horoscopes had matched and marriage was imminent.


Given the ongoing investigation and pending chargesheet, the court concluded that granting bail at this stage was unjustified. The judgment stressed that the accused's repeated assurances, followed by a sudden refusal, suggested deceitful intent from the outset, thus fulfilling the criteria for offense under Section 69 of the Bharatiya Nyaya Sanhita.
