Delhi High Court Denies Interim Bail to PFI Leader Anis Ahmed

Court Rejects Bail Plea Citing Security Threats and Serious Allegations Against Accused


In a significant ruling, the Delhi High Court has denied interim bail to Anis Ahmed, a senior member of the banned organization Popular Front of India (PFI). The bench, comprising Justices Prathiba M. Singh and Madhu Jain, delivered the judgment, rejecting Ahmed's plea for temporary release to meet his family members undertaking the Haj Pilgrimage. 


The court's decision came in the wake of serious allegations against Ahmed, including his involvement in unlawful activities and his pivotal role in the radicalization and recruitment of individuals for the PFI. The National Investigation Agency (NIA) opposed the bail plea, citing potential security threats posed by Ahmed, who was reportedly a key figure in the organization's operations. 


The court observed that interim bail could not be granted merely on religious or cultural grounds, especially in cases involving severe accusations like terrorism and conspiracy to commit unlawful acts. The judgment highlighted the importance of considering the accused's role and the potential threats associated with their release. 


Ahmed's counsel argued that the Haj Pilgrimage is a significant cultural and religious event, warranting a brief bail period for family interaction. However, the court emphasized that the allegations against Ahmed, including his involvement in planning and executing unlawful activities, outweighed the cultural considerations.


The judgment also referenced the charge-sheet against Ahmed, detailing his alleged activities within the PFI, such as inciting communal discord and planning armed insurrections. The court underscored the security risks, including possible disturbances and threats to public safety, that could arise from granting Ahmed interim bail.


This ruling aligns with previous judicial observations on the activities of the PFI, as noted in earlier cases such as O.M.A Salam v. National Investigation Agency. The court reiterated the need for a cautious approach in dealing with bail applications from individuals associated with banned organizations.


Bottom Line:

Interim bail cannot be granted to an accused involved in serious allegations of terrorism and unlawful activities merely on the ground of family members undertaking a religious pilgrimage, especially when the accused holds a significant position in a banned organization and poses a potential security threat.
