Court Emphasizes Balance Between Commercial Interests and Citizens’ Right to Peaceful Environment Under Delhi Excise Act and Bharatiya Nagarik Suraksha Sanhita
In a significant ruling, the Delhi High Court has directed the authorities to address grievances related to the unregulated operation of bars and lounges, specifically targeting the Bunon Bar and Lounge at R.K. Ashram Marg. The petitioner, Mahesh Chand, brought to the court's attention that the establishment was operating beyond the legally permitted hours, causing public nuisance. The court highlighted the importance of adhering to the Delhi Excise Act, 2009, and the Delhi Excise Rules, 2010, which regulate the operation of such establishments.
Justice Purushaindra Kumar Kaurav underscored the obligation of authorities to act upon public complaints to maintain public confidence in governance. The petitioner alleged that Bunon Bar operated until 4:30 AM on occasions and issued handwritten bills instead of GST-compliant ones, contravening legal requirements. Despite multiple complaints to various authorities, no action had been taken, prompting the court's intervention.
The court stressed that in a civil society governed by the rule of law, genuine complaints must not remain unaddressed. Emphasizing the need for a balance between commercial interests and citizens’ rights, the court acknowledged that while bars are allowed to operate, they must comply with existing regulations to ensure a peaceful environment for the community.
The court ordered the Excise Commissioner to investigate the petitioner’s grievances and take appropriate action within two months. It also directed that if necessary, the District Magistrate should be involved to resolve the issues effectively, ensuring cooperation among all concerned authorities.
