Court Orders Consular Access and Use of Technology for Contact Between Celina Jaitly and Her Brother


In a significant order issued by the Delhi High Court, measures have been directed to ensure effective communication between Celina Jaitly and her brother, Major (Retd.) Vikrant Kumar Jaitly, who is currently detained in the United Arab Emirates (UAE). The court, presided over by Justice Sachin Datta, addressed the ongoing issue of communication barriers faced by the petitioner with her brother, emphasizing the need for prompt consular access and innovative solutions to bridge the communication gap.


During the proceedings, the counsel for the petitioner highlighted the non-compliance of earlier directions regarding establishing contact with the detainee. Despite efforts by the Ministry of External Affairs, as detailed in a status report, communication had not been effectively established. The report indicated multiple instances of secured consular access, with the detainee expressing a preference for legal representation, which was being facilitated.


Acknowledging the challenges, the court issued a series of directives aimed at resolving the communication issue. These include obtaining consular access expeditiously, with the explicit task of informing the detainee about the addition of the petitioner's contact number to his calling card. The use of the UAE's TAMM App/Portal for facilitating visits and communication was also emphasized, with an assurance from Mr. Chetan Sharma, the Additional Solicitor General, that efforts would be made to ensure compliance with the court's directions.


The court further instructed that email confirmations regarding the compliance of these directives be sent to the petitioner, and any correspondence in this regard should include her. The possibility of personal visits was also considered, should technological means prove insufficient due to residency issues.


The case is scheduled for further consideration on December 23, 2025, with the court expecting a fresh status report detailing progress made in implementing these directions. This judgment underscores the court's commitment to upholding the rights of individuals detained abroad and the importance of diplomatic and technological avenues in ensuring effective communication.
