Delhi High Court Directs Mediation in EBC Publishing vs. Rupa Publications Dispute
Court Orders Completion of Pleadings and Initiates Mediation Process
In a significant development in the ongoing legal dispute between EBC Publishing (P) Ltd. and Rupa Publications India Private Limited, the Delhi High Court has directed both parties to engage in mediation while simultaneously completing all necessary pleadings. The judgment, passed by Justice Manmeet Pritam Singh Arora, addresses the application filed by the defendant, Rupa Publications, seeking the vacation of an ex-parte interim injunction previously granted in favor of EBC Publishing.
The court has ordered that both parties treat the application and its corresponding reply as pleadings, a move aimed at conserving time and resources. The plaintiffs and defendants have agreed to file their written statements and replications, which will serve as replies and rejoinders in the ongoing application process.
The court has scheduled a hearing for the applications on December 17, 2025, and has instructed both parties to submit written notes, not exceeding three pages, prior to the hearing. In a collaborative move, both parties have consented to refer the matter to the Delhi High Court Mediation & Conciliation Centre, underscoring a willingness to resolve the dispute amicably.
The court has requested the appointment of a Senior Mediator to facilitate the mediation process, with the first session scheduled for November 20, 2025. During this period, the parties are expected to complete the necessary pleadings and document admissions.
This case highlights the judiciary's inclination towards mediation and alternative dispute resolution mechanisms as a means to expedite legal proceedings and reduce the burden on courts. The outcome of the mediation process will be keenly observed by stakeholders in the publishing industry, given the prominence of the parties involved.
