Delhi High Court Dismisses Transfer Petition Alleging Bias in Domestic Case

Court finds no substantial evidence of bias; emphasizes legal remedies for unfavorable orders.

In a recent decision, the Delhi High Court, presided over by Justice Saurabh Banerjee, dismissed a petition filed by Jaspreet Kaur seeking the transfer of her case from the Mahila Court in Tis Hazari Courts, Delhi, citing alleged bias. The petition was filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), which allows for the transfer of cases on grounds of bias. However, the court found that the petitioner failed to substantiate her claims with material particulars.

The case in question involved the discharge of the petitioner's husband and mother-in-law, which Kaur claimed was a result of bias by the trial court. However, the High Court noted that the mere discharge of certain accused individuals does not inherently suggest bias. The court emphasized that an unfavorable order does not imply bias, especially when legal remedies are available to challenge such decisions.

Justice Banerjee observed that the issues raised by Kaur had already been addressed in a well-reasoned order by the Principal District and Sessions Judge, West District, Tis Hazari Courts. The court reiterated that extraordinary jurisdiction under Section 528 BNSS cannot be invoked without sufficient grounds and that the petitioner had alternative legal avenues to pursue her grievances.

The petition was dismissed in limine, with the court highlighting the importance of substantiating allegations of bias with concrete evidence. The decision reinforces the judiciary's stance on maintaining the integrity of legal processes and discourages the invocation of extraordinary jurisdiction without proper justification.

Bottom Line:

A petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking transfer of a case on grounds of alleged bias, was dismissed in limine as the petitioner failed to substantiate her claims with material particulars. The court held that a decision unfavorable to a party does not imply bias, especially when legal remedies are available.
