Delhi High Court Expresses Displeasure Over Advocate's Conduct; No Punitive Action Taken
Senior Advocate's Unorthodox Protest in Court Prompts Strong Reprimand, Case Adjourned for Compensation Discussions
In a recent hearing, the Delhi High Court voiced strong disapproval of a senior advocate's conduct during proceedings. Advocate Mr. R.K. Saini, a seasoned legal practitioner with over 25 years of experience, entered the courtroom with red tape affixed to his lips, a symbolic gesture protesting being silenced in previous hearings. This unusual act was aimed at conveying his dissatisfaction with the court's handling of his arguments in prior sessions.
The bench, comprising Justices Nitin Wasudeo Sambre and Anish Dayal, expressed displeasure at the advocate's conduct, describing it as "unbecoming" and "unexpected" of someone with his professional standing. Despite the provocation, the court refrained from imposing punitive measures, acknowledging Mr. Saini's long-standing career in the legal field. However, they placed their strong disapproval on record, emphasizing the need for respectful and professional conduct in court proceedings.
The proceedings also involved discussions on a compensation proposal by the State Government. A sum of Rs. 5,00,000 was offered to the petitioner, which Mr. Saini, representing the petitioners, refused. The court granted additional time for both parties to file necessary affidavits and rejoinders concerning the compensation offer.
The court scheduled the next hearing for January 21, 2026, allowing both sides time to prepare their responses. The case, titled "Court On Its Own Motion v. Delhi Administration," continues to draw attention due to the advocate's unorthodox protest and the ongoing negotiations regarding compensation.
Bottom Line:
Conduct of an advocate in court proceedings must be respectful and professional, irrespective of any dissatisfaction with the court's actions - Unbecoming conduct by a senior advocate was noted, but no punitive action was taken considering the advocate's long-standing career.
