Delhi High Court Frames Criminal Contempt Charges Against Advocate for Scandalous Allegations

Advocate Sanjucta Kabasi faces contempt charges for allegedly scandalizing the court through social media and court conduct.


In a significant development, the Delhi High Court has framed criminal contempt charges against Advocate Sanjucta Kabasi for allegedly making scandalous allegations against a judicial officer both during court proceedings and on social media. The charges stem from incidents related to ongoing legal matters in which Kabasi was involved as a party.


The matter came to light following a reference from the Court of the learned JMFC-06(C), THC, Delhi, highlighting Kabasi's conduct during court proceedings related to FIR No. 188/2019 and FIR No. 189/2019. It was alleged that during a hearing on January 25, 2025, Kabasi raised her voice, used unparliamentary language, and accused the court of collusion with the accused parties. Despite repeated warnings, Kabasi continued her conduct, prompting the court to adjourn the proceedings.


Further complicating matters, Kabasi allegedly posted defamatory content on LinkedIn targeting the judicial officer. The post, which was later deleted, was traced back to Kabasi through a detailed investigation involving LinkedIn Corporation and the Cyber Cell of the Delhi Police. The investigation revealed that the LinkedIn account from which the post was made was linked to Kabasi and her close associate.


The Delhi High Court, taking cognizance of the gravity of the allegations, has framed charges under Section 2(c) of the Contempt of Courts Act, 1971, which pertains to acts intended to scandalize or lower the authority of the court. Kabasi has denied ownership of the LinkedIn post and pleaded not guilty to the charges.


During the proceedings, the court emphasized the importance of maintaining the integrity of the judicial process and the authority of the courts. The court directed Kabasi to file an affidavit in response to the charges, as per the Contempt of Courts (Delhi High Court Rules, 2025), and to be personally present at the next hearing scheduled for May 26, 2026.


The court has also discharged LinkedIn Corporation and the investigating officer from future appearances unless required. This case underscores the judiciary's commitment to upholding its dignity and authority against any actions that may undermine its function.
