High Court Cites Non-compliance with Section 42 and Prolonged Incarceration as Key Factors in Granting Bail
In a significant ruling, the Delhi High Court has granted bail to Yusuf Aajam, accused under the Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act). The decision was delivered by Justice Anup Jairam Bhambhani, focusing on the non-compliance of statutory provisions and prolonged detention as critical considerations in the case.
Yusuf Aajam was arrested on charges related to the illegal possession and distribution of pharmaceutical drugs. The prosecution alleged that he was operating multiple pharmaceutical firms to procure and distribute contraband substances. The defense, led by Mr. Akshay Bhandari, argued that the drugs in question were purchased and held under valid licenses and that the case primarily involved regulatory infractions concerning the storage of these drugs.
A major turning point in the case was the alleged non-compliance with Section 42 of the NDPS Act. The court found merit in the argument that the officer who first received the information about the contraband did not personally forward it to a superior officer, which is a mandatory requirement under the Act. This procedural lapse raised questions about the legality of the search and seizure operations conducted at Aajam’s premises.
Furthermore, the court took into account the prolonged incarceration of the petitioner, who had been in custody for over two years without the trial reaching a conclusion. The court emphasized that pre-trial detention should not become punitive, especially when the trial is delayed.
In light of these factors, the court granted bail to Yusuf Aajam, setting conditions such as furnishing a personal bond, surrendering his passport, and ensuring no contact with prosecution witnesses. The court clarified that this decision should not influence the trial proceedings, which will continue independently.
