Bail Granted After Prolonged Incarceration and Delays in Trial; Court Balances Section 45 PMLA Rigours with Article 21
In a significant development, the Delhi High Court has granted bail to Dinesh Gupta, the Managing Director of M/s Best Foods Ltd., who was accused of money laundering under the Prevention of Money Laundering Act, 2002 (PMLA). The decision was handed down by Dr. Swarana Kanta Sharma, J., considering the prolonged pre-trial detention and the unlikelihood of the trial concluding within a reasonable timeframe.
Dinesh Gupta, who has been in custody since August 8, 2025, faced allegations of diverting and laundering substantial loan funds obtained fraudulently from a consortium of banks, including the State Bank of India. The Directorate of Enforcement (DoE) alleged that Gupta orchestrated these financial misdeeds through a network of shell entities and fictitious transactions, leading to an outstanding liability of approximately Rs. 1,740.30 crore.
Despite the gravity of the charges, the court acknowledged that the investigation concerning Gupta had concluded, and the evidence against him was primarily documentary, already collected by the authorities. With the trial still at the document scrutiny stage and no chargesheet filed in the predicate offense by the CBI, the court highlighted the improbability of the trial commencing and concluding in a reasonable period.
The court's decision was influenced by the constitutional guarantee of personal liberty under Article 21 of the Indian Constitution, which mandates a speedy trial. The court cited precedents from the Supreme Court, emphasizing that prolonged incarceration without trial completion could violate Article 21.
In granting bail, the court imposed stringent conditions to ensure Gupta's availability for trial proceedings and further investigation. He is required to furnish a personal bond of Rs. 2,00,000 with two sureties of like amount, surrender his passport, and appear before the trial court on every hearing date unless exempted.
