Urgent interim relief granted to protect 'BOMBAY MUSK' trademark and trade dress from counterfeit sales by Wellness Club and others.


In a significant ruling, the Delhi High Court has granted an ex-parte ad-interim injunction in favor of BG Innovators LLP, a Ghaziabad-based company known for its premium fragrances and personal care products under the brand 'BOMBAY MUSK'. The court's decision was aimed at halting the sale of counterfeit products by the defendants, including Wellness Club and other third-party sellers operating on the Flipkart platform.


The case, presided over by Justice Tejas Karia, was initiated by BG Innovators LLP to protect its registered trademarks and copyrighted trade dresses from being misused by the defendants. The plaintiff alleged that the defendants were selling inferior quality counterfeit products under deceptively similar brand names such as 'BOMBAYMUSK' and 'BOMBAYMUSKY', which were causing brand dilution and misleading consumers.


Citing the urgency of the situation, the court exempted the requirement for pre-litigation mediation under Section 12A of the Commercial Courts Act, 2015, as the plaintiff sought urgent interim relief. The court found a prima facie case in favor of BG Innovators LLP, highlighting the potential for consumer confusion and the erosion of the plaintiff's goodwill and reputation.


Justice Karia ordered an ex-parte ad-interim injunction restraining the defendants from manufacturing, selling, or advertising counterfeit products bearing the 'BOMBAY MUSK' trademark. Additionally, the court directed Flipkart to take down the infringing URLs and disclose details about the sellers involved.


To ensure compliance, the court also appointed local commissioners to inspect and seize counterfeit goods from the premises of Wellness Club and Krishiv Enterprise in Surat, Gujarat. The commissioners were authorized to secure evidence of infringing activities, with the assistance of local police if necessary.


This ruling underscores the judiciary's proactive stance in safeguarding intellectual property rights in the e-commerce sector, providing relief to legitimate businesses against the proliferation of counterfeit goods.
