In a significant ruling on October 16, 2025, the Delhi High Court, presided over by Justice Tejas Karia, granted an ex-parte ad-interim injunction in favor of CROCS Inc. and its subsidiary, protecting their trademarks, patent, trade dress, and design from infringement by Sagar Doijode, trading as Questsole, and others. The court observed that the defendants were using marks and designs deceptively similar to those of the plaintiffs, thereby infringing upon CROCS Inc.'s proprietary rights.


CROCS Inc., a globally recognized brand known for its distinctive footwear designs, accused Questsole of manufacturing and selling footwear and accessories that closely resembled their patented and trademarked products. The plaintiffs presented a compelling case, demonstrating their longstanding presence and goodwill in the footwear market, both internationally and in India. The court noted that CROCS Inc. holds registered trademarks for 'CROCS' and 'JIBBITZ', a patent for a system attaching decorative accessories to shoes, and a registered design for their unique footwear style.


The court found that Questsole's use of marks such as 'CROCKS' and 'JIBIT', along with their sale of clog-style footwear and charms, constituted a prima facie infringement of CROCS Inc.'s intellectual property. The balance of convenience favored the plaintiffs, with the court recognizing the irreparable injury that could result from continued infringement.


Justice Karia's order restrains Questsole and associated parties from using, selling, or advertising any products under marks or designs deceptively similar to those of CROCS Inc., either through their website or third-party e-commerce platforms. This decision underscores the judiciary's commitment to enforcing intellectual property rights and protecting companies against market confusion and reputational harm.


The case is slated for further proceedings on February 16, 2026, allowing time for the defendants to respond to the court's notice.
