Sporta Technologies, the owner of the renowned 'Dream11' fantasy sports platform, approached the court citing extensive misuse of their registered trademarks and copyrighted works by Come Sports. The defendant was found to be operating a rogue mobile application under the impugned 'Come Sports' marks, which closely mimicked Dream11's user interface, graphics, and promotional materials. This imitation was likely to cause confusion among the public, misleading them into believing an association with the legitimate Dream11 platform.
The court acknowledged the prima facie case presented by Sporta Technologies, highlighting the balance of convenience in favor of the plaintiff.
