The appellant, Umar Khalid, sought interim bail under Section 21(4) of the National Investigation Act, 2008, after the Additional Sessions Judge had rejected his request for bail in connection with the Chehlum ceremony of his uncle and his mother's surgery. Khalid's legal team, led by Senior Advocate Mr. Trideep Pais, highlighted previous instances where Khalid had been granted interim bail to attend family events, underscoring his compliance with bail conditions.


Despite the prosecution's argument that the surgery was minor and a brief visit under police escort would suffice, the court took an empathetic stance considering the appellant's mother's health situation. Recognizing the past interim bails granted for family events, the court decided to extend the same consideration for this personal circumstance.


The bail comes with stringent conditions to prevent any potential misuse or interference with the ongoing investigation and trial. Khalid is required to furnish a personal bond of Rs. 1,00,000 with a surety of the same amount and is restricted to stay within the NCR region, specifically at his residence and the hospital where his mother will be admitted. He is also required to provide his contact details to the authorities and is prohibited from contacting any witnesses or making any public statements related to the case.


The court emphasized that any breach of these conditions would result in the automatic cancellation of the interim bail. Khalid is expected to surrender to the jail authorities upon the completion of the bail period.


This decision follows the Supreme Court's earlier rejection of Khalid's regular bail application, where he was identified as a prime conspirator in the North-East Delhi Riots case. The interim bail is strictly for humanitarian reasons, allowing Khalid to be with his family during a critical time.
