Despite the lapse in trademark registration in 2009 due to the proprietor's health issues, the plaintiff's extensive use and substantial goodwill of the mark were pivotal in the court's decision.


Justice Gedela noted the visual and phonetic similarities between the two marks, highlighting that the defendant's mark lacked originality and could cause confusion among consumers. The court emphasized the plaintiff's prior use of the trademark, extensive promotional activities, and significant goodwill as critical factors in granting the injunction.


The court dismissed the defendant's arguments regarding the lack of territorial jurisdiction, citing the interactive nature of the defendant's website and potential delivery assurances in Delhi as sufficient grounds for jurisdiction.


Additionally, the court rejected the defendant's justification for adopting a similar mark, finding it lacked credibility and appeared to mimic the plaintiff's rationale for its trademark. The ruling underscores the protection of trademark rights based on prior use and goodwill, even in the absence of current registration.


The interim injunction restrains the defendant from using the mark "KONAFLEX" or any similar mark, emphasizing the plaintiff's rights over its established trademark "KOANAFLEX." The court's decision is a significant step in protecting intellectual property rights and preventing consumer confusion in the marketplace.
