Safex Chemicals India Limited successfully restrains Safex Seed India LLP from using similar trademarks


In a significant ruling, the Delhi High Court has issued an interim injunction against Safex Seed India LLP, preventing them from using, marketing, or dealing with goods and services under the trademark "SAFEX" or any deceptively similar mark. The court found that Safex Chemicals India Limited, the plaintiff, holds substantial goodwill and proprietary rights over the "SAFEX" trademark, which has been used extensively since 1991 in relation to agrochemical products.


Justice Tushar Rao Gedela presided over the case, CS(COMM) No. 595 of 2026, delivered on May 26, 2026. The court noted that Safex Chemicals India Limited had established its trademark through extensive use, registration, and promotion, which led to significant goodwill and reputation. The plaintiff demonstrated continuous use and registration of the "SAFEX" mark, supported by substantial sales and advertising efforts across India.


The defendant, Safex Seed India LLP, was found to be using an identical or deceptively similar trademark "SAFEX SEED," which the court deemed likely to cause confusion among consumers, particularly farmers and agriculturists. The court observed that the inclusion of the descriptive suffix "SEED" did not sufficiently distinguish the defendant's mark from the plaintiff's.


The court applied the principles of trademark law under the Trademarks Act, 1999, specifically focusing on sections 29 and 134, which address infringement and deceptive similarity. The balance of convenience was found to be in favor of the plaintiff, as failure to grant the injunction could result in irreparable harm to their established rights and reputation.


The court ordered that the defendants, their associates, and agents are restrained from using the plaintiff's trademark, trade name, logo, or any similar artistic device. This ruling underscores the importance of trademark protection and the court's role in safeguarding intellectual property rights.
