In a significant ruling, the Delhi High Court has granted a suspension of sentence to Dhruv Varma, enabling him to file a Special Leave Petition (SLP) before the Supreme Court. The decision came in light of substantial incarceration already undergone by Varma and procedural difficulties caused by court vacations.


The judgment, delivered by Justice Dr. Swarana Kanta Sharma, addressed the applications filed under Section 389 of the Code of Criminal Procedure, 1973, and Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The applications sought an extension of the suspension of the original sentence passed by the Trial Court on October 31, 2012.


Dhruv Varma was convicted under Section 138 of the Negotiable Instruments Act, 1881, across three connected complaints. The Trial Court had initially sentenced him to one year of simple imprisonment and imposed a compensation of Rs.50,00,000 for each complaint. Following an appeal, the Appellate Court modified the sentence, consolidating the compensation to Rs.1,00,00,000. However, the Delhi High Court reinstated the original sentence after dismissing Varma's criminal revision petitions on February 27, 2026.


The legal representatives for Varma argued that while preparing the SLP, procedural delays arose due to the Supreme Court's reduced functioning during vacations. Additionally, Varma has already served one year of incarceration, leaving only a potential default sentence of three months, should he fail to pay the compensation.


The High Court acknowledged the pending status of the case since 2007 and the prolonged legal proceedings extending over 12 years. It also considered Varma's intention to challenge the February 27 judgment in the Supreme Court. Consequently, the Court suspended the sentence's operation until April 28, 2026, allowing Varma to file his SLP within the 90-day limitation period.
