In a significant ruling, the Delhi High Court, presided over by Justice Jyoti Singh, has granted an interim injunction in favor of Hugo Boss AG against Shubham Jain, trading as Panipat Handlooms, for unauthorized use of its globally recognized trademarks "HUGO BOSS" and "BOSS." The court found that the defendant was manufacturing and marketing products with marks identical or deceptively similar to those of the plaintiff, causing trademark infringement and passing off.
The plaintiff, Hugo Boss AG, a renowned German company, argued that its marks, recognized and registered in multiple jurisdictions, including India, were being infringed upon by the defendant. The defendant was accused of selling cheaper replicas of Hugo Boss's luxury bedding, linen, and bath towels, with trademarks that could mislead consumers into believing that there was an association with the plaintiff’s high-quality products.
The court noted the plaintiff’s longstanding reputation and goodwill associated with the "HUGO BOSS" and "BOSS" trademarks, which are used on a wide range of products globally. Given the defendant's actions, the court agreed that the plaintiff had established a prima facie case of trademark infringement and passing off. The balance of convenience was found to be in favor of Hugo Boss, as the plaintiff was likely to suffer irreparable harm without the grant of interim relief.
The court's order restrains the defendant from using any identical or deceptively similar marks on its products until the next date of hearing. Additionally, the defendant is directed to remove all infringing advertisements and promotional content from various platforms, including social media, where the infringing marks were used.
This decision underscores the importance of trademark protection and the court's role in ensuring that well-established brands are not undermined by unauthorized use of their intellectual property. The case is set to proceed further, with a summons issued to the defendant to respond to the allegations.
