Trial Court's Conviction Exceeded Charges; Sentence Adjusted to Reflect Attempted Offence
In a significant judgment, the Delhi High Court, presided by Justice Chandrasekharan Sudha, has modified the conviction of Sudarshan, who was earlier sentenced by the trial court for committing aggravated sexual assault under the Protection of Children from Sexual Offences (POCSO) Act. The High Court held that the trial court erred in convicting the accused for an offence that exceeded the charges framed against him, which was only for an attempted aggravated sexual assault.
The case dates back to July 10, 2014, when the accused allegedly attempted an aggravated sexual assault on a minor girl aged 4½ years. The trial court had initially convicted Sudarshan for committing aggravated sexual assault and sentenced him to five years of rigorous imprisonment. However, the High Court found that the charge framed was for an attempt, not the commission of the offence, and thus the conviction was beyond the charge.
Justice Sudha emphasized that the conviction cannot exceed the charge framed, and consequently, the sentence was modified to reflect the correct charge under Section 18 read with Section 9(m) of the POCSO Act. The sentence was reduced to rigorous imprisonment for three and a half years.
