Delhi High Court Orders Investigation into Police Misconduct in Court Premises

Officer to Submit Written Apology; Zero FIR to be Registered for Intimidation and Threats


In a significant ruling, the Delhi High Court has directed an investigation into alleged misconduct by a police officer within the precincts of the court. Justice Arun Monga, presiding over the matter, expressed strong disapproval of the behavior of SI Narinder, who reportedly engaged in verbal abuse, intimidation, and threats against legal counsel and a complainant. The incident, which occurred just outside the entrance of the courtroom, sparked immediate concern among those present.


The judgment stems from a joint verbal complaint by the counsel for the appellant and the complainant in the case titled "Rameshwar v. State Govt. of NCT of Delhi." According to the judgment, SI Narinder's conduct was deemed unacceptable, particularly as he holds the responsibility of upholding the law rather than breaching it. Justice Monga emphasized that such behavior cannot be tolerated under any circumstances, highlighting the officer's arrogance and misuse of authority.


In response, Inspector Kishore Kumar from Police Station South Rohini has been ordered to register a zero FIR under relevant penal sections. The investigation is to be conducted by an officer not below the rank of Assistant Commissioner of Police, ensuring that the matter is handled with the seriousness it demands. The court has requested the Commissioner of Police to oversee the assignment of the investigation to a suitable officer.


Additionally, SI Narinder has been directed to submit an unconditional apology in writing by way of an affidavit. Despite verbal apologies offered during a later court session, the court insisted on a formal written submission, underscoring the gravity of the misconduct. The affidavit is to be filed by the following day, demonstrating the court's commitment to accountability and justice.


The case is set to be revisited on September 23, 2025, as the court continues to monitor compliance with its directives. This judgment serves as a reminder of the judiciary's role in safeguarding the integrity of legal proceedings and ensuring that all individuals, including law enforcement officers, adhere to the standards of conduct expected within the justice system.
