Court Challenges Legality of Disqualifying Candidates Due to Tattoos on Right Forearm
In a recent judgment, the Delhi High Court has raised significant concerns over the disqualification of candidates in recruitment processes based on tattoos located on the right forearm. The case, titled "Vipin Kumar v. Union of India," involves a petitioner who was disqualified from the recruitment process for the post of Motor Mechanic Vehicle due to having a tattoo on his right forearm. The petitioner expressed his willingness to undergo surgery to remove the tattoo to qualify for the position.
The court, comprising Justices C. Hari Shankar and Om Prakash Shukla, scrutinized the guidelines issued by the Ministry of Home Affairs concerning tattoos. These guidelines permit tattoos on traditional sites of the body, such as the inner aspect of the forearm, but only on the left forearm, which is considered the non-saluting limb. The court questioned the sustainability of such guidelines under the law.
The judgment highlighted that the traditional practice of tattooing in India usually involves religious symbols or figures and is typically located on the left forearm. However, the guideline's restriction against tattoos on the right forearm was challenged by the court, considering it potentially questionable and influenced by a view on western culture's impact on younger generations.
The court issued a notice to the respondents, requiring them to show cause as to why the rule nisi should not be issued, implying a preliminary view that the disqualification basis may be legally unsound. The respondents, represented by Mr. Rajendra Sahu, Special Public Counsel, accepted the notice and were directed to file a counter-affidavit within one week.
The judgment underscores the court's role in ensuring that recruitment guidelines are legally sound and not discriminatory. The case is set to be listed for disposal on November 17, 2025, in the supplementary list.
