Delhi High Court Takes Suo Motu Action to Address Dire Conditions in Night Shelters

Court Responds to Newspaper Report Highlighting Severe Cold Faced by Shelter Residents, Issues Directives for Immediate Improvements

In a significant move reflecting judicial activism, the Delhi High Court has taken suo motu cognizance of the harsh living conditions in the night shelters of the capital city. The court's action follows a report published in 'The Hindu' on January 11, 2026, which brought to light the severe conditions faced by residents amid the biting cold.

The bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia issued directions to the authorities, emphasizing the urgent need to provide adequate facilities to the residents of these shelters. The court has mandated the respondents, including the Delhi Urban Shelter Improvement Board (DUSIB), to ensure that the inhabitants are equipped to withstand the severe winter conditions.

The Public Interest Litigation (PIL) was registered based on the court’s own motion, highlighting the judiciary's proactive role in safeguarding the rights and well-being of vulnerable populations. The court expressed its concern regarding the state of the night shelters and stressed the necessity for immediate intervention by the responsible entities to address the inadequacies.

Notice has been issued to several respondents, including the central government and the Government of National Capital Territory of Delhi (GNCTD). The counsel representing these bodies, including Mr. Ashish Dixit, Central Government Standing Counsel, and Mr. Sameer Vashisht, Standing Counsel for GNCTD, have been tasked to provide comprehensive updates on the current status of night shelters across Delhi and the measures being implemented to ameliorate the conditions.

The court's order underscores the importance of prompt action, directing all concerned authorities to undertake adequate measures to safeguard the health and safety of the shelter residents from the chilling cold. The bench has scheduled the next hearing on January 14, 2026, and has ordered the matter to be placed high on the board, indicating the urgency and priority accorded to this issue.

This judicial intervention is seen as a pivotal step towards ensuring that the basic human rights of the homeless population in Delhi are respected and protected, especially during the harsh winter months. The court’s directives are expected to prompt swift action from the relevant authorities to improve the living conditions in these shelters and provide necessary amenities to the residents.
