Delhi High Court Upholds 2022 Seniority List, Dismisses Challenge by Direct Recruit PGT

Court Rules Interview Timing Cannot Determine Seniority; Managing Committee's Approved Seniority List and Departmental Promotion Committee’s Recommendation Valid


In a significant judgment dated 27th February 2026, the Delhi High Court dismissed a writ petition filed by Ms. Jolly Batoo, a direct recruit Post Graduate Teacher (PGT) in Commerce at Lady Irwin Senior Secondary School, challenging the validity of the seniority list finalized in March 2022 by the Managing Committee. The petitioner sought restoration of her seniority position as per an earlier seniority list dated 9th October 2020, asserting that her seniority should be based on the “date of selection” and the timing of her interview.


The court, presided over by Justice Sanjeev Narula, emphasized that seniority in the PGT grade in recognized aided schools is governed by Rule 109 of the Delhi School Education Rules, 1973. The rule mandates that seniority be determined primarily by the order of merit on the occasion of selection and that inter se seniority between direct recruits and promotees must follow the rotation of vacancies as per recruitment rules.


Rejecting the petitioner’s contention that the timing of the interview (forenoon session) should influence seniority, the court held that Rule 109 does not recognize interview session timing as a criterion for seniority. The court observed that the October 2020 seniority list, which placed the petitioner above the promotee respondent Ms. Sharda Verma, was not a valid or final determination as it lacked approval by the Managing Committee, was signed under protest, and was followed by objections and representations. On the other hand, the March 2022 seniority list was duly approved by the Managing Committee, the competent authority under the Rules, and has since governed service matters, including promotions.


The court further clarified that seniority cannot be claimed from a date when an employee was not part of the cadre. Ms. Verma, a promotee, was promoted to PGT (Maths) with effect from 14th July 2008, prior to the petitioner’s joining on 13th August 2008. The judgment cited binding Supreme Court precedents — including K. Meghachandra Singh v. Ningam Siro and Jagmohan Vishwakarma v. UOI — to reinforce that seniority is reckoned from the date of appointment, not from selection or interview dates.


Addressing procedural fairness, the court found no breach of natural justice in the finalization of the 2022 seniority list. The petitioner had opportunities to object and pursue representations against it. The court underscored that mistaken seniority positions do not have to be perpetuated indefinitely, and stability in seniority lists is crucial for institutional administration.


Lastly, the court upheld the Departmental Promotion Committee (DPC) meeting held on 28th November 2024, which recommended promotion of Ms. Verma to the post of Vice Principal based on her seniority and eligibility. Since the petitioner’s challenge to the seniority list failed, her challenge to the DPC recommendation was also dismissed.


The interim order restraining the promotion was vacated, allowing the respondents to proceed with the promotion in accordance with law.


This judgment clarifies the legal position on seniority determination in aided schools, emphasizing merit-based selection order, proper authority approval, and adherence to recruitment rules, while negating the use of administrative factors like interview timing as proxies for seniority.
