In a significant judgment, the Delhi High Court has upheld the admission of Kumar Saurabh and Kumari Subhargi Priya, siblings of a deceased sailor in the Indian Navy, to the MBBS course under Defence Category Priority-III. The court found that the cancellation of their admission by Guru Gobind Singh Indraprastha University was unsustainable, as it violated principles of natural justice and lacked formal reasoning.


The case revolves around the eligibility of siblings of deceased unmarried Defence personnel for reservation under Priority-III, which is typically reserved for widows and wards of Defence personnel who died attributable to military service. The deceased, Kumar Shubham, was categorized as "Death Attributable to Military Service" after dying from an electric shock during operational duty.


The siblings' admission was initially granted after scrutiny of their documents, including the Relationship Certificates issued by the Naval Pension Office, and was certified by the Rajya Sainik Board. However, the admission was later cancelled based on an informal communication from the Board, which was challenged in a writ petition.


The court ruled that the cancellation was made without providing a fair hearing or formal reasoning, thus violating the principles of natural justice. It emphasized that admissions cannot be arbitrarily cancelled once granted after due verification of documents. The judgment also interpreted the term "wards" within the Ministry of Defence Circular and the university's admission brochure, concluding that it could include siblings when the deceased was unmarried.


The court found support in other policy instruments and precedents that recognize siblings as part of the family unit entitled to benefits extended to wards of Defence personnel. It noted that the principles laid down by the Supreme Court in past judgments apply to the present case, supporting the restoration of the siblings' admissions.


The judgment dismisses the appeal filed by Guru Gobind Singh Indraprastha University, allowing the siblings to continue their studies in the MBBS course and granting them consequential reliefs in law. This decision is seen as a reinforcement of the principles of natural justice in educational admissions, particularly concerning Defence personnel reservations.
