Court Dismisses Pleas Against MCD's Penalty and Sealing Orders, Reinforces Compliance with MPD 2021 and Delhi Fire Service Rules


In a significant ruling, the Delhi High Court has reinforced the obligation for coaching and tuition centers to secure a mandatory Fire No Objection Certificate (NOC), irrespective of their location within a building, as per the Master Plan for Delhi (MPD) 2021 and the Delhi Fire Service Rules, 2010. The judgment, delivered by Justice Amit Bansal, dismissed a series of writ petitions filed by Heena Aleem and others against the Municipal Corporation of Delhi (MCD). The petitioners challenged the MCD's demands for conversion charges, penalties for misuse, and the sealing of their properties due to the absence of a Fire NOC.


The court underscored that compliance with fire safety norms is not merely restricted to centers operating from basements but is applicable across all floors. The decision aligns with a previous ruling by a Division Bench in the case of Sanjay Singhal v. State Govt. of NCT of Delhi, which clarified the comprehensive applicability of fire safety requirements.


Furthermore, the court addressed the petitioners' grievances regarding the conversion and misuse charges levied by the MCD. It held that these issues involve disputed questions of fact, which are not suitable for adjudication under writ jurisdiction. The MCD had followed due process by adjusting amounts already paid by the petitioners and providing a hearing before issuing a speaking order. The court directed the MCD to de-seal the properties once the petitioners fulfilled the requisite payment obligations.


The judgment also highlighted that the petitioners, who had vacated the subject properties, must obtain a Fire NOC if they intended to operate any coaching centers from the premises in the future. This ruling reinforces the importance of adhering to regulatory requirements to ensure public safety.

Requirement of Fire NOC for coaching and tuition centers is mandatory under MPD, 2021 and Delhi Fire Service Rules, irrespective of whether the centers operate from the basement or any other floor.
