In a significant decision, the Delhi High Court dismissed a writ petition filed by Bijender Kumar Gaur against the North Delhi Municipal Corporation, upholding the Central Administrative Tribunal's earlier ruling. The case revolved around Gaur's claim for interest on delayed salary and retiral benefits, which the Tribunal had declined. The High Court, comprising Justices Anil Kshetarpal and Amit Mahajan, reaffirmed that Gaur's own conduct contributed to the delay in payments, thus negating his entitlement to interest on these dues.


Gaur, who served as a Lower Division Clerk before being promoted to Principal, retired in 2007. He sought interest on delayed payments, but the Tribunal found that the delays were due to his failure to complete necessary formalities like signing pay bills and providing bank details. Consequently, the Tribunal only awarded interest at 6% per annum on honorarium and bonus for election duties, covering the period from 1996 to 2017.


The High Court emphasized that its jurisdiction under Articles 226 and 227 of the Constitution does not permit it to act as an appellate body over Tribunal findings unless there is a jurisdictional error or a manifest perversity. It endorsed the Tribunal’s reliance on documentary evidence showing Gaur's non-cooperation as the cause of the delay, thereby justifying the denial of interest on the delayed salary and retiral dues.


Additionally, the Court noted that the Tribunal's dismissal of Gaur's review application was appropriate, as no error apparent on the face of the record was demonstrated. The High Court reiterated that the review jurisdiction is not an appellate jurisdiction and requires a clear error to warrant alteration of the order.


The decision marks the end of a prolonged legal battle for Gaur, with the High Court confirming the Tribunal's orders and dismissing the writ petition, along with any pending applications.

Claim for interest on delayed salary and retiral benefits must demonstrate that the delay was not caused by the claimant's own conduct, and findings of fact by the Tribunal are not to be disturbed unless they are wholly unreasonable or unsupported by evidence.
