In a significant ruling, the Supreme Court of India has upheld the Rajasthan Public Service Commission's (RPSC) requirement that candidates for the post of Assistant Prosecution Officer must possess the requisite educational qualifications at the time of application submission. This decision overturns the Rajasthan High Court's earlier judgment which allowed candidates who acquired qualifications after the application deadline to participate in the selection process.


The case, titled "Rajasthan Public Service Commission v. Lavanshu Sankhla," was adjudicated by Justices Vikram Nath and Sandeep Mehta. The key issue was the interpretation of the eligibility criteria under the Rajasthan Prosecution Subordinate Service Rules, 1978, specifically whether candidates must have the necessary qualifications by the application date or any subsequent date before interviews.


The RPSC had issued an advertisement on March 7, 2024, for 181 Assistant Prosecution Officer positions, stipulating that applicants must have a degree in law at the time of application. However, some candidates who submitted applications were yet to complete their law degrees but obtained them before the preliminary examination. The High Court had previously allowed these candidates to sit for the examination, prompting an appeal by the RPSC.


The Supreme Court's judgment emphasized that the relevant date for determining eligibility, including educational qualifications, is the application submission date. It highlighted that the governing rules and advertisement clearly required possession of the degree at the time of application, a criterion not subject to alteration by subsequent acquisition of qualifications.


The Court also referenced the deletion of a proviso in Rule 12 of the Rajasthan Prosecution Subordinate Service Rules, 1978, which previously allowed candidates appearing in final year exams to apply. This deletion, according to the Court, reflected a clear legislative intent that candidates must have completed their qualifications by the application deadline.


Rejecting the High Court's approach that favored a broader interpretation of eligibility, the Supreme Court stated that such an interpretation would introduce uncertainty and administrative challenges in the recruitment process. The Court applied the legal maxim "aliquid prohibetur ex directo, prohibetur et per obliquum," underscoring that what cannot be done directly cannot be done indirectly.


In conclusion, the Supreme Court set aside the High Court's judgment, reaffirming the RPSC's stance on educational qualifications, and thereby reinforcing the principle that recruitment rules must be adhered to as clearly stated in the advertisement and governing legislation.
