In a significant judgment, the Bombay High Court has dismissed a Chamber Summons filed by Auto Credit Corporation, seeking intervention in a testamentary suit regarding tenancy rights. The court imposed exemplary costs of Rs. 25,00,000 on the Applicant for engaging in frivolous litigation and causing unnecessary delays and hardships to the Court Administrator.
Justice Kamal Khata, presiding over the case, emphasized that tenancy claims should be adjudicated in the Small Causes Court, which holds exclusive jurisdiction over such matters. The court found that Auto Credit Corporation was merely an occupant and lacked tenancy rights, thereby having no standing in the testamentary proceedings.
The issue arose when the Applicant sought removal of a seal on a premises under administration, claiming tenancy rights. The court noted that the Applicant had tampered with the sealed premises, an act constituting an abuse of the judicial process. The court further criticized the Applicant for failing to comply with procedural directions, leading to delays in the final hearing of the suit.
The court observed that the Administrator, who was appointed to collect rent, did not possess the authority to seal or dispossess occupants without court permission. Despite these limitations, the Applicant's actions led to the imposition of exemplary costs, which are to be paid to the Armed Forces Battle Casualties Welfare Fund within four weeks.
The ruling underscores the judiciary's commitment to deterring frivolous litigation and ensuring that judicial processes are not exploited to delay or defeat justice. The court has directed that if the costs are not paid within the stipulated time, the properties of the Applicants will be attached for recovery.
