Court Emphasizes Need for Enhanced Security for Judicial Officers Following Incident
In a significant ruling, the Gauhati High Court has granted bail to Hafijur Rahman and Atowar Rahman, accused of threatening and assaulting a Judicial Magistrate in Assam. The decision was delivered by Justice Pranjal Das on December 18, 2025, under the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023.
The case arose from an incident on December 1, 2025, where the informant, a Judicial Magistrate-cum-Civil Judge from Bilasipara, Dhubri, was allegedly threatened and abused by the accused while traveling to his office. The confrontation escalated when the accused reportedly attempted to physically assault the Magistrate, prompting him to flee the scene.
During the hearing, the Additional Public Prosecutor argued against bail, citing the severity of the offense and the incriminating evidence available, including the statements of witnesses and the accused. However, Justice Das, acknowledging the despicable nature of the accused's conduct, considered the progress of the investigation and the duration of their detention to justify granting bail.
The court imposed stringent conditions on the bail, including a bond of Rs. 30,000 for each accused, regular reporting to the police, and restrictions on leaving the jurisdiction of Dhubri district without court permission. The court emphasized that any violation of these conditions could lead to the cancellation of bail.
Justice Das also took the opportunity to highlight the security concerns for Judicial Officers, particularly those involved in criminal cases. He urged the state government to review and enhance the personal security arrangements for Judicial Officers to prevent similar incidents in the future.
The ruling not only addresses the immediate case but also brings attention to the broader issue of ensuring the safety of those serving in the judiciary.
Bottom Line:
Bail application under Bharatiya Nagarik Suraksha Sanhita, 2023 - Accused charged with offences against a Judicial Magistrate - Bail granted considering progress of investigation, length of detention, and subject to stringent conditions.
