Interim Order Issued to Prevent Cutting of Heritage Trees for Road Widening Project
The Gauhati High Court has intervened to halt the cutting of trees in Aizawl city following a public interest litigation filed by environmental activist Ms. Saizampuii Sailo. Representing the Centre for Environment and Social Justice (CESJ), the activist raised concerns over the proposed road widening project, which threatens the existence of 174 trees, some of which are estimated to be around 100 years old.
The court, comprising Justices Michael Zothankhuma and Kaushik Goswami, expressed apprehension regarding the environmental impact and heritage value of these trees located on land vacated by the Assam Rifles. The project aims to expand the main road from Bazar Bungkawn to Treasury Square to 14 meters, a development that necessitates significant tree felling in the heart of the city.
The petition highlighted the crucial role these trees play as carbon sinks in Aizawl, a city characterized by dense urban infrastructure. The environmental activist argued that removing these trees would exacerbate pollution levels, adversely affecting the city's inhabitants.
The court took note of various newspaper articles that underscored the gravity of the situation. The Times of India and The Assam Tribune both published reports on the issue on April 20, 2026, while the Aizawl Post featured an article dated April 16, 2026, revealing that some of the trees earmarked for removal date back to the year 1850.
Additionally, the land in question holds historical significance, with structures such as the barrack area constructed in 1897, adding to the site's heritage value. The court emphasized the need for the State Government to provide a comprehensive explanation for the tree felling, given the ecological and historical implications.
During the proceedings, the court issued an interim order restraining the State Government from cutting any more trees until a satisfactory explanation is provided. The State Government, represented by Additional Advocate General Ms. P. Bhattacharyya, acknowledged the notice and assured the court of its commitment to addressing the matter seriously.
Senior Counsel Mr. T.J. Mahanta, advocating for the petitioner, insisted on the necessity of interim protection and underscored the importance of obtaining a proper rationale before proceeding with any further tree removal.
The matter is scheduled for further hearing on May 18, 2026, allowing the State Government time to present its case. Meanwhile, the court's interim order ensures the preservation of the trees, safeguarding both the environment and the heritage of Aizawl city.
