Sessions Judge Tinsukia's Judgment Overturned Due to Jurisdictional Overreach


In a significant ruling, the Gauhati High Court has remanded a case for rehearing after identifying a procedural lapse by the Sessions Judge, Tinsukia. The case, involving petitioners Sibo Prasad Choudhury and others against respondents Bicky Khan and others, was initially adjudicated in the trial court where the petitioners were acquitted of charges under Sections 325/166/34 IPC. However, the Sessions Judge upheld a previously set aside judgment, leading to a critical examination by the High Court.


The core issue stemmed from the Sessions Judge's decision to rely on a judgment dated April 30, 2011, which had been nullified by a subsequent appellate decision. The Gauhati High Court, presided over by Justice Anjan Moni Kalita, found that the Sessions Judge exceeded his jurisdiction by upholding this non-existent judgment. The High Court's ruling emphasized the necessity for the Sessions Judge to assess the appeal based solely on the merits of the judgment dated August 27, 2013, which acquitted the petitioners.


The original matter began with an FIR filed on April 21, 2007, by the respondent no. 2, alleging severe assault by police personnel, including ASI Sibu Prasad Choudhury, resulting in serious injuries to Bicky Khan. Following a series of investigations and court proceedings, the SDJM, Margherita, acquitted the petitioners, which was subsequently challenged in the Sessions Court.


The High Court's decision mandates that the Sessions Judge, Tinsukia, re-hear the appeal afresh within two months, disregarding the previously set aside judgment from 2011. This ruling underscores the importance of procedural integrity and jurisdictional adherence in appellate proceedings, ensuring justice is served based on accurate legal foundations.
