Court Finds Prima Facie Evidence of Misuse of Legal Identity and Swindling of Rs. 80 Lakh
In a significant ruling, the Gujarat High Court has denied anticipatory bail to Sadhu Falguni Mitesh Kumar, a law student accused of fraudulently posing as an advocate and allegedly misappropriating funds amounting to Rs. 80 lakh. The court, presided over by Justice P. M. Raval, determined that the evidence presented necessitated custodial interrogation to further investigate the extent of fraudulent activities and uncover any involvement of other individuals.
The applicant, who is yet to complete her LL.B., faced accusations of using fake identity credentials to deceive clients under the pretense of providing legal services. The investigation revealed that visiting cards, seals, and other paraphernalia indicating her as an advocate were recovered. Despite being a law student, items such as a nameplate suggesting her as an advocate of the Supreme Court, and various seals and registers, were found at her residence and workplace.
The court was unconvinced by the defense's argument that the accusations were maliciously fabricated and that the applicant was merely performing administrative tasks for her brother-in-law, who is a practicing advocate. The defense also pointed to a delay in lodging the complaint as indicative of the falsity of the allegations.
However, the prosecution argued that the applicant had systematically siphoned funds by exploiting her false identity, with several victims stepping forward during the investigation. The court agreed with the prosecution's stance that custodial interrogation was essential to trace the roots of the alleged offense and protect the integrity of the legal profession.
In its judgment, the court emphasized the importance of maintaining the noble profession of advocacy free from tarnishment by such fraudulent activities. The court found no exceptional grounds to grant anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and thus rejected the application.
The defense's request for a stay on the order, to allow an appeal to the Supreme Court, was also denied.
