Court Orders Trial for Negligence Leading to Deaths under Section 304A IPC


In a significant ruling, the Gujarat High Court has discharged several engineers from charges of culpable homicide not amounting to murder, under Section 304 of the Indian Penal Code (IPC), in connection with the tragic collapse of a staircase at a government girls' hostel in Vyara, Gujarat. The collapse, which occurred on January 26, 2007, resulted in the death of 11 girls and injuries to others.


Presiding over the case, Justice Hasmukh D. Suthar assessed the evidence presented, which included allegations of the use of inferior quality materials and negligence in supervising the construction. The court found that while there was a lack of intention or knowledge to cause death, which ruled out charges under Section 304 IPC, the engineers' actions did constitute negligence. Therefore, the trial against them will proceed under Section 304A IPC, which addresses causing death by negligence.


The engineers, who were serving in the Roads & Buildings Department during the construction period from 1989 to 1994, were accused of not adhering to building codes and using substandard materials. Despite the structure withstanding the 2001 earthquake, the investigation revealed deficiencies in supervision and material quality.


The court highlighted the importance of a judicial filter before the commencement of a trial, emphasizing the need to only allow cases with a legal foundation to proceed, thereby safeguarding the rights of the accused and ensuring judicial efficiency. As a result, the engineers will face trial for negligence under Section 304A IPC, along with related charges under Sections 337, 338, and 114 IPC.


The court's decision underscores the distinction between culpable homicide and negligence, affirming that while negligence was evident, there was no intention or knowledge of causing death. The case will now be returned to the competent court for further proceedings under the applicable sections.
