Convict's Bail Extended Due to Health Needs; No Untoward Incidents Reported During Previous Bail Period
The Gujarat High Court has granted an extension of temporary bail to Ashumal @ Asharam Thaumal Sindhi (Harpalani), a convict, on medical grounds. The decision was made by a Division Bench comprising Justice Ilesh J. Vora and Justice R.T. Vachhani. The court considered the need for constant medical surveillance, periodic evaluation, and immediate access to emergency care as pivotal factors for extending the bail period.
Asharam, who sought an extension of his temporary bail for six months, was previously granted bail on November 6, 2025, in connection with Criminal Appeal No. 607 of 2023. During the hearing, the advocate for Asharam emphasized the necessity of continuous medical supervision due to the convict's health condition, as outlined in the application, particularly in paragraphs 28 to 30.
The Public Prosecutor, Mr. Hardik Dave, supported by Mr. L.B. Dabhi, Assistant Public Prosecutor, presented a report from the Assistant Commissioner of Police, SIT/Woman Cell, Crime Branch, Ahmedabad City, to the court. The prosecution expressed reservations about the application, citing the pending appeal before the High Court of Rajasthan at Jodhpur, where the judgment has been reserved after the conclusion of the hearing.
Despite the prosecution's arguments, the court chose to extend Asharam's temporary bail until June 15, 2026, on the same terms and conditions as the prior bail order. The judges noted the absence of any untoward incidents during Asharam's previous bail period and acknowledged the medical grounds necessitating the extension.
The matter is scheduled for further hearing on June 12, 2026, where subsequent proceedings regarding Asharam's bail will be discussed.
