Gujarat High Court Mandates Comprehensive Scheme for Silicosis-Affected Individuals

Court Directs State to Enhance Awareness and Accessibility of Welfare Schemes for Silicosis Victims


In a landmark decision, the Gujarat High Court has directed the State Government to implement a comprehensive scheme to assist individuals affected by Silicosis, as well as the dependents of deceased victims. The judgment, delivered by Chief Justice Sunita Agarwal and Justice D.N. Ray, addresses the administrative challenges faced by Silicosis victims in accessing government welfare schemes.


Silicosis, a debilitating lung disease often affecting workers in industries such as mining and construction, has long posed significant health risks. The court's intervention follows a petition filed by the Peoples Training And Research Centre, highlighting the need for a streamlined approach to distribute benefits effectively to affected individuals.


In response to the petitioners' concerns, the Gujarat Government issued a Circular on April 21, 2026, designating Assistant Government Labour Officers in each Taluka as Nodal Officers. These officers are tasked with ensuring administrative convenience and procedural clarity for affected persons and their dependents in filing applications for benefits under various State schemes. The court emphasized the necessity of this appointment, recognizing the need for dedicated assistance in navigating bureaucratic processes.


Additionally, the court has mandated the State to notify the public regarding available welfare schemes for Silicosis-affected persons. This notification is to be widely disseminated through advertisements and public outreach initiatives, ensuring maximum awareness among potential beneficiaries. However, due to the ongoing local body elections and the enforcement of the Model Code of Conduct (MCC), the allocation of funds for these awareness campaigns is temporarily withheld. The State has assured that once the MCC is lifted, prioritization will be given to these initiatives.


The judgment underscores the importance of government accountability in addressing the plight of Silicosis victims. By requiring a comprehensive scheme and emphasizing the role of Nodal Officers, the court aims to facilitate easier access to entitlements, thereby improving the quality of life for affected individuals.


The case is set to be reviewed again on July 14, 2026, allowing the Secretary, Labour Skill Development & Employment Department, Government of Gujarat, time to submit a follow-up report on the implementation of the court's directives.
