Gujarat High Court Mandates Strict Compliance with Child Protection Laws

Directions Issued to Strengthen Implementation of Juvenile Justice, Child Rights, and POCSO Acts in Gujarat


The Gujarat High Court, in a significant ruling dated February 27, 2026, has directed the State of Gujarat to ensure the effective implementation and compliance with statutory requirements under the Juvenile Justice (Care and Protection of Children) Act, 2015, the Commissions for Protection of Child Rights Act, 2005, and the Protection of Children from Sexual Offences Act, 2012. This directive comes in response to a Public Interest Litigation (PIL) filed by Bachpan Bachao Andolan, highlighting gaps in the enforcement of child protection laws across the state.


The Division Bench, comprising Chief Justice Mrs. Sunita Agarwal and Justice D.N. Ray, emphasized the critical role of District Magistrates in grievance redressal and quarterly reviews of the Child Welfare Committees (CWCs) to ensure statutory compliance. The court held that District Magistrates are empowered to take cognizance of complaints against CWCs and ensure their compliance with the legal provisions.


The court has mandated the State Commission for Protection of Child Rights to monitor the enforcement of child rights laws and the provisions under the Juvenile Justice Act and POCSO Act. The judgment highlighted several implementation gaps, including inadequate infrastructure in Child Care Institutions, procedural lapses by CWCs, lack of separate institutions for girls and boys, and the non-display of Child Welfare Police Officers' details in police stations.


The Gujarat High Court has directed the State Government to frame and adopt a Child Protection Policy as per the POCSO Rules, 2020, to ensure zero tolerance towards violence against children. Furthermore, the court has ordered a social audit of child care institutions to ensure transparency and accountability, with reports to be submitted within a specified timeframe.


The court has set a deadline of June 30, 2026, for the completion of these tasks, including the preparation of annual and special reports by the State Commission. The State Legal Services Authority and District Legal Services Authorities have been tasked with submitting compliance reports on implementation gaps in Child Care Institutions and CWCs.


The judgment underscores the necessity for a coordinated effort by various state bodies to uphold the rights and welfare of children in Gujarat. The matter is scheduled for further compliance review on April 30, 2026.
