The order had rejected Advance Greenfield Pvt Ltd's application for an industrial use certificate for a plot of land in Vadodara. The rejection was based on issues such as unverifiable agricultural certificates and incomplete documentation.


The petitioner argued that the rejection was arbitrary and beyond the jurisdiction conferred under Section 63AA. The court concurred, observing that the rejection was not on merits but rather on technical grounds that did not warrant a permanent denial. The court further noted that the administrative process under Section 63AA does not preclude the filing of a new application once deficiencies are addressed.


The judgment underscored that revenue authorities had exceeded their jurisdiction by focusing on technical objections instead of the substantive industrial purpose of the land acquisition. The court directed that if a fresh application is filed, it should be considered independently and in accordance with the law, without bias from the previous rejection.
