Court Affirms Central Administrative Tribunal's Decision, Rejects Union's Appeal on Grounds of Misrepresentation and Delay


In a significant ruling, the Gujarat High Court has reaffirmed the appointment of a physically handicapped candidate, Chirag, as Postal Sorting Assistant, dismissing the Union of India's appeal against the Central Administrative Tribunal's (CAT) decision. The Division Bench comprising Justices N.S. Sanjay Gowda and J.L. Odedra delivered the judgment on 16th March 2026, emphasizing the legislative policy favoring the inclusion and encouragement of physically handicapped individuals.


The case revolves around Chirag's application for the Postal Sorting Assistant post, which required a 10+2 qualification with English as a compulsory subject. Chirag's application was initially rejected by the postal authorities on the grounds that his mark sheet indicated he had passed 10+2 without English as a compulsory subject. However, it was noted that Chirag had cleared English as an additional subject, leading to allegations of misrepresentation.


Chirag challenged the rejection before the CAT, which quashed the rejection order and directed his appointment. The CAT's decision was based on precedents where similarly situated candidates received relief. The Union of India then appealed against the CAT's order, asserting misrepresentation and delay in Chirag's approach to the CAT, branding him a "fence sitter."


Justice Sanjay Gowda, delivering the judgment, dismissed the Union's appeal, stating that the claim of ineligibility based on educational qualifications was unfounded in light of previous litigation concluded by the High Court's Division Bench. The court highlighted that the "fence sitter" principle is not applicable to physically handicapped candidates due to legislative policies encouraging their inclusion.


The court took judicial notice of the nation's legislative policies that advocate for the inclusion and reservation of physically handicapped individuals in suitable posts. It emphasized that the Postal Sorting Assistant position is ideal for accommodating candidates with disabilities. Furthermore, the CAT's discretion in condoning the delay in Chirag's application was not challenged by the Union, making the delay argument untenable.


The judgment underscores the judiciary's role in upholding legislative intent and providing justice to marginalized groups, particularly physically handicapped individuals. This ruling reaffirms the commitment to equitable and inclusive employment opportunities in public service sectors.
