The wife alleged that she was subjected to mental and physical cruelty and was driven out of her matrimonial home, leading her to seek higher maintenance. The husband's objection was based on the wife's earning capability, claiming she earned approximately Rs. 15,000 per month through tailoring.


However, the High Court emphasized that the wife's earning should not be the sole criterion for denying maintenance. Referring to precedents set by the Supreme Court, including the case of Sunita Kachwaha v. Anil Kachwaha, the Court reiterated that a wife's inability to maintain herself remains a pre-condition for granting maintenance, regardless of her earning status.


Justice Suthar noted that the husband's increased income and lack of substantial liabilities justified the enhancement of maintenance. The Court highlighted the husband's legal and ethical duty to maintain his wife, allowing her to enjoy a standard of living commensurate with his status and income.


The ruling reflects the broader scope of relief under the Domestic Violence Act compared to Section 125 of the Cr.P.C., as seen in the case of Lalita Toppo v. State of Jharkhand. The Court stressed that monetary relief must balance the husband's earning capacity with the wife's needs.


Ultimately, the High Court found no patent error in the Family Court's judgment, affirming its findings and dismissing the revision application.
