Court recognizes grave and sudden provocation in the case of Hasmukhbhai Vasava, maintaining conviction under Section 304 Part-II IPC.
The Gujarat High Court has upheld the conviction and sentence of Hasmukhbhai Bhurabhai Vasava, who was found guilty of culpable homicide not amounting to murder under Section 304 Part-II of the Indian Penal Code (IPC). The court confirmed the five-year rigorous imprisonment sentence previously handed down by the Additional Sessions Judge, Panchmahal, Godhra.
The case revolved around an incident from 1997, where Vasava discovered his wife, Dhirajben, in a compromising position with another man in their residence. In a fit of rage and provoked by the situation, Vasava assaulted his wife, which led to her death. His defense argued that the act was not premeditated and occurred due to grave and sudden provocation, citing Exception-1 to Section 300 of the IPC.
The prosecution, represented by APP Ms. Jyoti Bhatt, contended that the act was brutal and premeditated, urging the court to maintain the conviction. The defense, led by advocate Mr. V.D. Parghi, argued for leniency, emphasizing the sudden and grave provocation Vasava experienced upon witnessing the act.
Justice Ms. Gita Gopi, presiding over the case, examined the evidence and testimonies, including extra-judicial confessions made by Vasava to an ambulance driver and his superior officer. The court concluded that the provocation was indeed grave and sudden, aligning with the criteria set out in Exception-1 of Section 300 IPC. However, the court dismissed the plea for a reduced sentence under self-defense provisions, as the threat was not immediate or life-threatening.
The judgment underscores the delicate balance the legal system must maintain in cases of provocation and self-defense, ensuring that the punishment fits the nuances of the crime.
Bottom Line:
Exception-1 to Section 300 IPC - Culpable homicide not amounting to murder - Grave and sudden provocation leading to loss of self-control - Accused caused death of his wife upon witnessing her in compromising position with another man in his own house, followed by verbal provocation. Benefit of Exception-1 granted, sentencing under Section 304 Part-II IPC upheld.
Statutory provision(s): 300 IPC, 304 Part-II IPC, 8 Evidence Act, 25 Evidence Act, 27 Evidence Act
