High Court Upholds Preventive Detention of Vilayat Aziz Mir Under Public Safety Act

Court dismisses plea challenging detention citing security concerns and alleged juvenile status during prior offenses.


In a significant ruling, the Jammu and Kashmir High Court has upheld the preventive detention of Vilayat Aziz Mir, an 18-year-old, under the Jammu & Kashmir Public Safety Act, 1978. The decision came after Mir's petition challenging the detention order on grounds of juvenile status during prior offenses and alleged fabrication of detention grounds was dismissed. The judgment, delivered by Justice Rahul Bharti, emphasized the petitioner's potential risk to state security and his association with terrorists, thereby justifying the preventive detention order.


Mir was detained following an order by the District Magistrate, Pulwama, on April 30, 2025, citing his involvement in activities prejudicial to state security, including a terror attack in 2021. Despite Mir's arguments that his juvenile status at the time of the prior offense should mitigate the detention and claims of fabricated grounds, the court found no merit in these challenges.


The court scrutinized the procedural compliance regarding notice, explanation of grounds of detention, and representation rights, concluding that the petitioner was duly informed and given the opportunity to represent himself. The representation made by Mir was considered and rejected by the competent authority, further reinforcing the detention's validity.


Mir's alleged criminal activities included involvement in the killing of the owner of Krishna Dabha in Srinagar, an incident registered under various sections of the Indian Penal Code, Indian Arms Act, and Unlawful Activities (Prevention) Act. Despite being a juvenile at the time of the incident, the court stated that his age could not be considered a mitigating factor given his ongoing activities posing a threat to state security.


The court also rejected Mir's plea for compensation, asserting that the grounds for detention were not fabricated as claimed. The judgment highlighted Mir's continued association with known terrorists and his alleged involvement in activities as an Over Ground Worker for active terrorists, which substantiated the preventive detention.


The ruling underscores the court's stance on preventive detention as a necessary measure in cases where an individual's activities pose a significant threat to state security. The dismissal of the writ petition marks a reaffirmation of the state's authority under the Jammu & Kashmir Public Safety Act to detain individuals deemed a risk to public safety.
