Supreme Court Remands Jurisdictional Issue Back to High Court in Rajeev Mehta Case, Apex Court Emphasizes Mandatory Application of Section 225 of Bharatiya Nagarik Suraksha Sanhita, 2023


In a significant ruling, the Supreme Court of India has remanded a case back to the High Court for reconsideration of a jurisdictional issue, underscoring the mandatory application of Section 225 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The case, Rajeev Mehta @ Rajiv Kishor Kirtilal Mehta v. Param Bir Singh, highlights crucial procedural aspects regarding the territorial jurisdiction of magistrates.


The bench, comprising Justices M.M. Sundresh and Prasanna B. Varale, addressed two primary issues in the appeal. The first issue pertained to the territorial jurisdiction of the trial court, which the High Court had not considered despite being specifically raised. The second issue involved the application of Section 225 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in conjunction with Section 223 of the same code.


The Supreme Court found merit in the appellant's argument concerning the application of Section 225. This section mandates that upon receiving a complaint involving an accused who resides outside the magistrate's territorial jurisdiction, the magistrate must satisfy themselves of jurisdiction before proceeding. The Court noted that in this case, the appellant resides in Mumbai, beyond the magistrate's jurisdiction, necessitating the application of Section 225.


The High Court's oversight in addressing the jurisdictional issue led the Supreme Court to set aside its finding on this matter. The apex court directed the High Court to determine the jurisdictional issue within three months, emphasizing the necessity of jurisdictional clarity before the exercise of judicial power under Section 223.


In the interim, the Supreme Court has stayed proceedings before the trial court pending the High Court's decision on the jurisdictional matter. This ruling underscores the importance of adhering to statutory mandates to ensure fair trial processes, particularly when jurisdictional questions arise.


The Supreme Court's decision reinforces the procedural rigor required under the Bharatiya Nagarik Suraksha Sanhita, 2023, ensuring that jurisdictional questions are addressed at the outset of judicial proceedings, thereby upholding the principles of justice and due process.
