Court Finds Recruitment Process Lacks Statutory Backing; Orders State to Reassess Outsourcing Practices
In a significant ruling, the Himachal Pradesh High Court has put a temporary halt on the recruitment of Assistant Staff Nurses in the state, citing the absence of necessary amendments to recruitment rules. The bench, comprising Chief Justice G.S. Sandhawalia and Justice Bipin C. Negi, expressed strong reservations about the ongoing recruitment processes that were conducted without statutory backing.
The case, titled "Bal Krishan v. State of Himachal Pradesh," highlighted the illegality of the recruitment process for Assistant Staff Nurses, which was being conducted based on a government policy rather than amended recruitment rules. The court's decision came after an affidavit filed by the Special Secretary (Health) revealed significant vacancies in the health sector, with 1,535 posts for Staff Nurses remaining unfilled. Despite these vacancies, the court noted that the recruitment of Assistant Staff Nurses had proceeded without amending the necessary rules, leading to legal discrepancies.
Furthermore, the court raised concerns over the state's increasing reliance on outsourcing for government roles, which was observed to be a temporary and need-based arrangement under Rule 112 of the H.P. Financial Rules, 2009. The affidavit from the Principal Secretary (Finance) disclosed that over 26,724 employees had been hired through outsourcing agencies, a significant increase from previous figures.
The court directed the state to refrain from issuing any further appointment letters for Assistant Staff Nurses and questioned the legitimacy of appointments made under the current unamended rules. The bench also ordered the state to submit a detailed affidavit addressing the regular vacancies and the number of outsourced recruits in the last three years.
